A note from Karen Loftus

Dear 9/11 Families,

As you know, the case of US v. KSM, et al is progressing in Military Commission in Guantanamo Bay, Cuba. We have reached a stage in the case where the defense typically begins to conduct its own investigation of the facts of the case. In their investigation, the defense may attempt to contact persons who may be witnesses in the case or who otherwise may have information that the defense believes is relevant for their purposes. The defense may learn about such persons through media reports, their own investigative work or documents provided by the prosecution in the legal process known as discovery. Because of the possibility of such contact, we wanted to provide you with some information.

You may receive an email, letter, or phone call from a member of one of the five defense teams asking to speak with you. Any time you receive such a solicitation or outreach from someone purporting to be a United States government employee or contractor, you can and should clarify to what organization the individual belongs to. You can meet or speak with them, or you may choose not to. It is entirely up to you. You may also request that a member of the prosecution team or a member of VWAP be present at any meeting or on any phone call. You may call this office to verify the caller’s status or affiliation. This information is not meant to impede your access to the defense or to encourage or discourage you from communicating with any person associated with the Prosecution or Defense of this case. It is simply a notice that you may receive such a communication in the future.
